1. Acceptance of these Terms

These Terms & Conditions ("Terms") are a legal agreement between you and FitTimer ("we", "us", "our") governing your use of the FitTimer mobile application (the "App"). By downloading, installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. You must be old enough to form a binding contract where you live, or use the App with the consent of a parent or guardian.

2. Important health and safety notice

• FitTimer is a timer and tracking tool, not medical advice, a coaching service or a substitute for a qualified professional.
• Exercise carries risk of injury. Consult a doctor before starting any exercise programme, especially if you have a medical condition, are pregnant, are injured or have been inactive.
• You are solely responsible for the workouts you create and perform, including intervals, rest periods and intensity. The App does not check that a set is safe or suitable for you.
• Stop immediately if you feel pain, dizziness or discomfort. Do not use the App in a way that distracts you from your surroundings (for example while driving or near hazards).

3. The App and what it does

FitTimer lets you:

• build reusable exercise sets made of activity blocks (timed or rep-counted) and rest blocks, and assign each a set type;
• run a workout full-screen with a countdown, pause/resume, skip, ±15-second adjustment, sound cues, optional background soundtrack, haptic cues and a keep-awake screen;
• keep a local history of workouts with streaks and analytics;
• earn XP, levels, badges, daily and weekly quests, streak shields and cosmetic timer-ring colours (together, "Gamification");
• customise sounds, vibration and theme, set a weekly goal and profile name, and export / import a backup of your data.

All of your data is stored locally on your device. We may change, add or remove features at any time.

4. Licence

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use. All rights not expressly granted are reserved. Use of the App is also subject to the terms of the app store you downloaded it from (Apple Media Services Terms, Google Play Terms of Service). Apple and Google are not responsible for the App.

5. Acceptable use

You agree not to:

• copy, modify, reverse engineer, decompile or attempt to extract source code, except where law permits;
• circumvent or tamper with the App's free/PRO restrictions, advertising, purchase checks or Gamification (including by editing a backup file or modifying the device to grant yourself PRO);
• use the App for unlawful purposes or in a way that interferes with its operation;
• remove proprietary notices, or sell, rent, sublicense or distribute the App.

6. Free and PRO tiers

If a PRO subscription ends you keep access to, and can run, any sets you already saved, but you cannot save new sets beyond the free limit and PRO-only audio options revert to the free options. The features included in each tier may change, but we will not remove features from a period you have already paid for.

7. Subscriptions and payments

• PRO is an auto-renewing subscription with the billing period (for example monthly or yearly) and price shown on the purchase screen before you confirm. Prices may vary by region and include applicable taxes.
• Payment is charged to your Google Play or Apple ID account at confirmation of purchase. The subscription renews automatically unless cancelled at least 24 hours before the end of the current period (or per your store's rules). Your account is charged for renewal within 24 hours before the period ends.
• Manage or cancel in your store account settings (Google Play → Payments & subscriptions; iPhone Settings → your name → Subscriptions). Deleting the App does not cancel the subscription.
• Any free trial or introductory offer shown on the purchase screen applies as stated there; an unused portion of a trial is forfeited when you purchase.
• Refunds are handled by Google or Apple under their policies; we cannot issue refunds for store purchases. Except where required by law, fees are non-refundable for partial periods.
• Use Restore Purchases to re-activate PRO on a new device or after reinstalling, using the same store account. Subscription status is verified with the store and cannot be transferred between store accounts.

8. Your data, backups and responsibility

Your data is stored only on your device. We cannot access, back up or recover it. If you delete the App, clear its storage, lose or reset your device, your data may be permanently lost unless you have exported a backup. You are responsible for keeping backups. Backup files are plain text and unencrypted; keep them secure. Restoring a backup merges it into existing data and may include data created by another version of the App; we are not responsible for backup files that are corrupted, edited or from untrusted sources. 9. Gamification

XP, levels, badges, quests, streaks, streak shields and ring colours are for motivation and entertainment only. They have no monetary value, cannot be exchanged or transferred, and may be adjusted, reset or rebalanced in updates. Awards are calculated on your device from the workouts you complete in the App; we do not guarantee they reflect actual physical effort.

10. Advertising and third-party services

The free version displays ads from third parties (Google AdMob). We do not control or endorse advertisers' content and are not responsible for it or for any dealings between you and an advertiser. The App relies on third-party services (such as app stores and Google). Your use of those services is governed by their own terms. Links and in-app web pages may lead to content we do not control.

11. Intellectual property

The App, including its design, text, graphics, icons, sounds and soundtracks, code and the FitTimer name and logo, is owned by us or our licensors and protected by intellectual-property laws. You retain ownership of the content you create (such as set names and your profile name); you grant us no licence to it because it stays on your device, except as needed to display it to you within the App.

12. Feedback

If you send us suggestions or feedback, you agree we may use them without restriction or compensation.

13. Availability, updates and termination

We aim to keep the App working but provide it "as is" and "as available". We do not guarantee uninterrupted or error-free operation (for example sound or background playback behaviour can vary by device, operating-system version and battery settings). We may update, suspend or discontinue the App or any feature. You may stop using the App at any time by uninstalling it. We may suspend or end your licence if you breach these Terms. Sections that by their nature should survive termination will survive.

14. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not warrant that timers, cues, haptics, streaks or statistics will be accurate, timely or uninterrupted, or that the App is free of errors or harmful components. Nothing in these Terms limits rights you have under mandatory consumer law.

15. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits or goodwill, or for any injury or health harm arising from exercise you perform, arising from or related to your use of the App. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim. Some jurisdictions do not allow certain limitations, so some of this may not apply to you, and nothing excludes liability that cannot be excluded by law (such as for fraud or death or personal injury caused by negligence).

16. Indemnity

To the extent permitted by law, you agree to indemnify us against claims, losses and expenses arising from your breach of these Terms or your misuse of the App.

17. Disputes

Before filing a claim, please contact us at support@fittimer.app so we can try to resolve it informally. Nothing in these Terms limits any rights you have under mandatory consumer law where you live.

18. Apple and Google terms

If you downloaded the App from the Apple App Store: these Terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support; in the event of a failure to conform to any warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation; Apple is not responsible for claims relating to the App; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. If you downloaded from Google Play, the Google Play Terms of Service also apply.

19. Changes to these Terms

We may revise these Terms from time to time. The "Last updated" date shows the latest version, posted at https://fittimer.app/terms. If changes are material we will notify you in the App or on that page. Continuing to use the App after changes take effect means you accept them.

20. General

These Terms and the Privacy Policy are the entire agreement between you and us about the App. If a provision is found unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger or sale of the App.
